Abstract

This study aims to offer a critical account on how transitional justice discourses have framed the legal arrangement for the paramilitary demobilization process in Colombia. It seeks to explore not only the official accommodation of concepts of retributive and restorative justice, used to construct an acceptable offer for the paramilitary leadership, but civil society contestation over the meaning, requirements, and ownership of transitional justice processes more generally. In this respect the paper provides a background on the conflict in Colombia, highlights the views of the various constituencies in the process and gives an in-depth analysis of the Justice and Peace law, which has been the subject of a broad debate, both domestically and internationally.
